DISCLAIMER
Terms & Conditions of Service
Having contracted the services of OKC Private Investigations & Process Server (hereinafter referred to as OKC PIPS), which includes but is not limited to process serving, private investigation, polygraph examination, notary public services, nationwide skip tracing, document retrieval and nationwide criminal background reporting, you (hereinafter referred to as the Client), do hereby acknowledge and agree that all applicable fee costs will be charged to you according to the fee schedule recommended by OKC PIPS. These fees are expected to be charged per service rendered, with or without results of the search, and must be paid in full unless otherwise contracted in writing.
Fee Structure & Billing
Clients are charged for each inquiry or service performed. For example, there will be a fee per process service, per polygraph exam, per NAC check, or skip trace and background check, etc., against the prevailing price schedule. These charges cover administrative expenses, labor, subscriptions to third-party databases, and software usage, even where no conclusive result or data is generated.
Clients can consult our official fee schedule, where our rates are clearly indicated before they can be available. Payments must be made at the end unless otherwise agreed before the commencement of the work. Clients will know that the termination of a search or an investigation does not abate the debt incurred to date regarding the work performed.
Accuracy, Reliability & Third‑Party Limitations
OKC PIPS endeavors to deliver accurate and current information. However, most of the information obtained, including public records, property filings, court records, financial listings, motor vehicle records, credit bureau data, asset registries, etc., is obtained by third-party vendors whose data may not be totally up-to-date, fully thorough, or without any lapses in data.
In contracting our services, you acknowledge these shortcomings and hold OKC PIPS free of liability for third-party entities' inaccuracy, omission, outdated data, or poor performance. Data can face legal limitations, not be promptly updated, or unavailable in low-population areas; none of these are in our custody.
Scope of License & Legal Compliance
OKC PIPS has all the necessary licenses granted by the state of Oklahoma to serve as a process server, private investigator, notary public, and polygraph examiner. We are doing business strictly in accordance with the existing federal, state, and local regulations, including, but not limited to, licensing statutes, chain-of-custody requirements, vehicle codes, notary laws, and polygraph laws.
Clients are under obligation to ascertain that they have legal rights under Oklahoma and federal laws to demand and use the information that we gathered. This involves adhering to privacy laws, and any other law that relates to the possible use of background checks and skip traces.
Permissible Use & Client Responsibility
Only legal intent (court filings, formulation of legal strategy, litigation support, personal investigation, etc.) can be pursued using the information found through OKC PIPS. Its use in any way that violates any state or federal law, including but not limited to identity theft, stalking, harassment, unauthorized surveillance, or other illegal actions, is strictly forbidden.
The Client agrees to take personal responsibility for the legal usage of all the information that is obtained. OKC PIPS will not be liable for any misuse, redistribution, unauthoritative sharing, or publishing of the received information through our services. The Client shall be solely responsible for any third-party requests of service occasioned by abuse.
Confidentiality & Non‑Disclosure
Client information and data about their case are considered confidential. Okc Pips has organizational, technical, and procedural security against unauthorized access. We observe practices to ensure the security and confidentiality of data as per industry standards.
Any information provided to third-party vendors, including but not limited to process servers, skip-trace companies, database houses, or courier services, shall be done on a need-to-know basis and for the furtherance of the agreed service. The non-disclosure agreements placed on the third-party vendors require them to work under confidentiality requirements proportional to our policies.
Process Service & Service Attempt Policy
Process servers go the extra mile to deliver legal documents, yet they cannot ensure that they are signed and received by the recipient. All attempts are incorporated with due diligence (e.g., identified individuals, witness information, GPS-proven tracking). Extra attempts may be necessary, each triggering additional fees.
Even when the service is unsuccessful, the Client remains financially liable despite incomplete or complete failure in the delivery. Other affidavits may be prepared on client request and at standard billing rates, either in connection with a substitution of service or filing of a document or court motions on which the affidavits are founded.
Private Investigation, Skip Tracing & Background Reports
In cases where private investigations or skip-tracing occurs, the OKC PIPS applies commercial databases accessed through the internet and available to the general public; in addition, we utilize categories of public fundaments, online searches, court records, social media, and professional networks. Names, as well as present addresses, phone names, employment history, criminal filings, civil judgment, liens, bankruptcies, and links to relationships may be found in the reports.
Clients know that such searches are not possible without the availability and accuracy of the source. Our industry best practices are in use, although we do not ensure exhaustive or up-to-date outcomes. Records may not be reported when: Records obscured as being public records Not a matter of public record Sealed records, Expunged records, any clients requiring deep financial or bank account information are required to provide legal accompaniment that can be directed to lawyers or forensic accountants; this cannot be achieved by regular means of investigation.
Polygraph Examination & Notary Services
These polygraph tests are administered in accordance with agreed-upon scientific methods by certified polygraphists. Nevertheless, the results of a polygraph can be post-interpreted, and the outcome can be influenced by sensitivity to anxiety or physiology. Clients understand that no legal decision or judgment is equated with the results, and neither is the provision of psychological counseling or legal advice.
Notary tasks are performed under Oklahoma Notary law. Clients must provide valid IDs and documents. OKC PIPS does not take the blame for the misusage of the notarized documents following the completion of the notarization.
Refusal & Termination
OKC PIPS has the prerogative to deny or terminate services at our whims without prior notice if the request contravenes the law, ethics, or policy in our internal regulations. In that event, the Client is still liable for services already performed. There will be no definite guarantee of refund or prorated credits; it will be on a case-by-case basis.
Third‑Party Vendors & Liability Waiver
OKC PIPS can use third-party vendors, i.e., databases or couriers, to meet requests. Clients are ready to accept the provisions where vendors can use non-proprietary software, and information can be obsolete, inaccurate, or insufficient. We disclaim liability for inaccuracies in vendor data.
In situations where the delivery is delayed because of an error on the part of the vendor, the Client is accountable for all costs; the Client alone shall not cause a refund and damages that might follow in the event of a vendor error.
Indemnification
Client consents and releases OKC PIPS and its officers, employees, agents, and affiliates from any actions, losses, or costs that may arise due to the use of the information obtained by Client, misuse of its services, or law offense. This incorporates legal charges that are used to defend misuse claims.
Disclaimer of Warranties & Limitation of Liability
Okc, Pips do not warrant services and expressly excludes all warranties, implied or express, including merchantability or fitness of a particular purpose.
OKC PIPS's liability towards the Client will be reduced to a minimum, i.e., to the maximum amount of the actions presented to the Client under the condition that the charges have been issued on the services in question. OKC PIPS and its representatives will not, under any situation, be liable for indirect, punitive, incidental, or consequential damages, even in cases motivated in advance.
Governing Law & Dispute Resolution
This disclaimer is governed by Oklahoma law. Any claims in the present agreement shall be determined in the Oklahoma County state or federal courts. Jurisdiction is mandatory.
The client will agree that any suit or arbitration should be brought within one year of the event being argued; otherwise, the Client will forego any legal action.
Severability & Amendments
In case any provision on the disclaimers comes out as unenforceable, the others still stand. OKC PIPS has the right to revise this disclaimer at any time. Any material change would be announced through email or through a notice hoisted on our website. Continued usage of services implies acceptance of amendments.
ACKNOWLEDGEMENT
The continued use of OKC PIPS services such as process serving, private investigation, polygraphs, notary, skip tracing, docs, or background reports, among others, will be taken as full understanding and acceptance of all mentioned above-mentioned terms. You also testify that you did not withhold any matter whatsoever that would restrict or impede in any way, that information received by you in regards to the Okc PIPS is true and current as far as you are aware of.
